Susan Stroh, 67, of Angola, Indiana was rear-ended by a Dump Truck owned by the Steuben County Highway Department on CR 200 North in Steuben County on Tuesday, July 6, 2021, around 12:45 p.m. according to a local news article. It was reported that Stroh was eastbound on CR 200 North at the time of the crash. Police report that Stroh suffered a head injury and broken bones. She was airlifted to a local Fort Wayne hospital and was reported to be in critical condition. While the cause of the crash is still under investigation, the use of alcohol and drugs are reportedly not suspected.
Indiana Tort Claim Act – You Must Act Quickly
The statute of limitations to bring a lawsuit against someone in Indiana is typically two years from the date of loss. However, when the person who causes the crash is a government employee a Notice of Tort claim is required much sooner. According to Indiana Code 34-13-3 you must place the government on Notice with the filing of a Notice of Tort Claim within 180 days from the date of loss when the loss is caused by a city or county employee. If the loss is caused by an employee of the State of Indiana the notice of claim must be filed within 270 days. It is critical to consult a knowledgeable attorney quickly as failing to file a tort claim notice within the required time frame will very likely bar someone from any remedy because of the loss. There are exceptions to this deadline for example if the injured party is incapacitated or is a minor, but you should have a knowledgeable attorney guiding you through this process each step of the way.
